A road traffic accident gives rise to compensation rights that the liable driver's insurer must meet. The scale set out in Royal Legislative Decree 8/2004 fixes the amounts, but applying it correctly — with every head of loss included — is neither automatic nor straightforward.

Do I have to accept the insurer's first offer? +

No. The initial offer can be reviewed and, where appropriate, challenged. It is worth checking it against an independent valuation to see whether it really matches the scale and the seriousness of the injuries.

What if there is no police report of the accident? +

Although a police report gives legal certainty, other evidence can be used: a European Accident Statement, witnesses, photographs, footage or medical reports consistent with how the collision happened.

Can I claim if my injuries only appear days after the accident? +

You can, provided there is a clear link between the accident and the injury. It is essential to seek medical attention as soon as possible and to have the traumatic origin of the symptoms recorded.
