This is not everything you are entitled to This figure covers only the recovery period. Any permanent sequelae, medical expenses, earnings lost while you were signed off and damage to the vehicle are claimed separately. Sequelae are valued in points and depend on the medical report and on your age: they are usually the largest item, and no automatic tool can calculate them.

How each day is classified

The four grades of harm

Very serious

Loss of personal autonomy for almost every essential activity: eating, dressing, moving about. This is the grade for the most severe injuries and for time spent in intensive care.

Serious

Temporary loss of autonomy for a significant part of daily life, or for your working activity. It includes days spent as a hospital inpatient.

Moderate

You cannot carry on your usual activity: signed off work, in a cast, in a neck brace, on crutches. This is the most common grade and usually matches the days you were signed off.

Basic

The remaining days until discharge, when you are back to normal life but still under treatment or awaiting a review.

Before you claim

The deadline: one year

It runs from the date your injuries stabilise, not from the day of the accident. If there were criminal proceedings, it runs from the day they end. It is a short period and easily lost.

Which year applies

Article 40.1 of the Spanish motor insurance act requires the system in force on the day of the accident to be applied, updated to the year in which the compensation is fixed. That is why you see two figures.

Frequently asked questions about accident compensation

What are days of harm and how are they counted?+

They are the days between the accident and the day you are discharged or your sequelae stabilise. They are classified into four grades according to how much they limited you: very serious if you lost your personal autonomy, serious if you were hospitalised or on complete bed rest, moderate if you could not carry on your usual activity, and basic for the rest of the recovery period. Each grade is paid at a different daily rate.

Why do I have to state the year of the accident?+

Because the scale is updated every year. Article 40.1 of the Spanish motor insurance act provides that the amounts of the system in force on the date of the accident apply, updated to the year in which the compensation is determined. That is why the calculator shows you both figures: the amount under the rates for the year of the accident, and the amount under today's rates.

Does this include permanent sequelae?+

No. This calculator covers only temporary injury, that is, the recovery period. Any sequelae that remain afterwards are valued separately, in points, and depend on the medical report and on your age: two people with the same sequela receive very different sums depending on how old they are. That part cannot be calculated with an automatic tool, and it is usually the most important one.

What about expenses, the car and my lost earnings?+

Those are not included here either. In addition to personal harm, you claim medical and travel expenses, the income lost while you were signed off and the damage to the vehicle. They are separate heads of loss and have to be evidenced with invoices and payslips.

How long do I have to bring a claim?+

One year from the date your injuries stabilise, not from the day of the accident. If there were criminal proceedings, time starts to run when they end. It is a short period and easily lost, so it is best not to let it slip.

The insurer has made me an offer. Should I accept it?+

Compare it before you sign anything. The insurer must put forward a reasoned offer within three months and, since the reform introduced by Act 5/2025, must break down and justify how it has calculated each head of loss. That breakdown is precisely what lets you see whether days, sequelae or expenses have been left out. Signing a full and final settlement closes the claim.
