How long do I need to have been in Spain to apply for arraigo?
It depends on the type of arraigo. As a general rule arraigo social requires a longer period of continuous residence than other forms of arraigo, in addition to further requirements such as the social integration report or a job offer, depending on the case.
Can I appeal the refusal of a residence permit?
Yes. There is a deadline for the administrative appeal (recurso de reposición) or for the judicial review claim before the administrative courts, depending on the case. It is worth going through the file to identify the exact reason for the refusal before appealing.
How long does Spanish nationality by residence take?
Decision times vary and can run to more than a year. An application that is properly documented from the outset reduces the risk of further requests for information, which lengthen the procedure.
What do I do if my permit expired while I was waiting for the renewal?
If the renewal was applied for within the deadline, the regulations provide for the previous status to be extended while the application is decided. It is important to be able to evidence the date on which the renewal application was filed.
Do expulsion proceedings mean I have to leave the country immediately?
Not necessarily. The proceedings follow their own procedure, with deadlines for submitting representations, and the decision can be appealed. It is important to act from the moment you are notified that proceedings have been opened, rather than waiting for the final decision.
